RE: The tariff classification of Mirapol 100 and Mirapol 100S poly(dimethyldiallyl ammonium chloride) based thermoplastic resins from Canada.

Dear Ms. Bahr:

In your letter dated June 30, 2006, you requested a tariff classification ruling for Mirapol 100 and Mirapol 100S poly(dimethyldiallyl ammonium chloride) based resins. Your samples were submitted to our laboratory for analysis and cannot be returned.

Based on Customs Laboratory Reports NY20061255 and NY20061256, the products are non-aromatic synthetic polymers specified in Note 3 to Chapter 39, not elsewhere specified or included, in primary forms. The products are not elastomeric and are other thermoplastic polymers.

The applicable subheading for Mirapol 100 and Mirapol 100S poly(dimethyldiallyl ammonium chloride) based thermoplastic resins will be subheading 3911.90.9010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for: Petroleum resins, coumarone-indene resins, polyterpenes, polysulfides, polysulfones and other products specified in note 3 to this chapter, not elsewhere specified or included, in primary forms: Other: Other: Other: Thermoplastic. The rate of duty will be 6.5 percent ad valorem.
